By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by these terms and conditions of sale and use (the "Terms"), including the additional terms, conditions and policies referenced herein and/or available by hyperlink, in particular our Refund policy and our Privacy policy. These Terms apply to all users of the Site and to all sales concluded on the Site with consumers.
Please read these Terms carefully before placing an order. By confirming your order, you acknowledge that you have read and accepted them. The Terms that apply to your order are those in force on the date of the order.
Our store is hosted by Shopify International Limited, 2nd Floor, 1–2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland. They provide us with the online e-commerce platform that allows us to sell our products to you.
Section 1 – Online store terms
By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence, or that you have the consent of your legal guardian.
You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms, viruses or any code of a destructive nature. A serious breach of these Terms may result in the suspension of your access to the Service.
Section 2 – General conditions
We reserve the right to refuse an order for a legitimate reason, in particular in the case of an abnormal order, suspected fraud or an existing dispute with the customer.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without our express written permission.
The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.
Section 3 – Accuracy, completeness and timeliness of information
We take great care with the information published on the Site. The essential characteristics of our products (dimensions, materials, care) are presented on each product page and are binding on us. Other content on the Site (tips, articles) is provided for general information.
This site may contain certain historical information. Historical information is, by definition, not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time.
Section 4 – Prices and modifications to the Service
Our prices are shown in the currency displayed on the Site for your country: Canadian dollars (CAD), or pounds sterling (GBP) for customers in the United Kingdom. VAT not applicable, article 293 B of the French General Tax Code. Any shipping costs are shown to you before you confirm your order. For deliveries outside the European Union, customs duties or import taxes may be charged by the destination country; they are paid by the customer.
Prices for our products are subject to change without notice. However, the price that applies to your order is the one displayed when you confirm it: a later change will never be applied to you.
We reserve the right to modify or discontinue the Service (or any part of it) at any time, without affecting orders that have already been confirmed.
Section 5 – Products
Certain products may be available exclusively online through the website. These products may have limited quantities. Their return or exchange is governed by Section 9 and by our Refund policy.
We have made every effort to display as accurately as possible the colours and images of the products that appear in the store. However, we cannot guarantee that your screen will display colours accurately.
We reserve the right to limit the quantities of any products we offer, to limit sales to certain geographic regions, and to discontinue any product at any time. If a product you ordered becomes unavailable, we will let you know and refund you within 14 days of your payment at the latest.
Our mats are comfort products: they are not a substitute for advice from a veterinarian.
Section 6 – Orders and accuracy of account information
To order, choose your products, add them to your cart, enter your details and delivery method, check the summary, then proceed to payment. You can correct any input errors before confirming. The sale is concluded once payment is accepted. You then receive a confirmation email summarizing your order.
We may limit the quantities purchased per person, per household or per order, in particular where orders appear to have been placed by dealers, resellers or distributors. If we change or cancel an order, we will notify you at the email address or phone number provided when the order was placed and refund you in full.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update it, including your email address, so that we can complete your transactions and contact you as needed.
Section 7 – Payment
Payment is made online when you place your order, through Shopify's secure payment solution. The accepted payment methods are shown at the payment step. Your card details are always encrypted during transfer: HappyHeats never has access to them.
Section 8 – Delivery
We deliver in France and internationally, to the countries offered at checkout, at the address you provide. Every order is shipped with a tracking number, sent to you by email.
The estimated delivery time is 6 to 10 business days. It may be longer for some international destinations and during busy periods (Black Friday, the holiday season). Unless another time frame is stated when you order, your parcel is delivered no later than 30 days after the sale is concluded.
In the event of a delay, you can ask us in writing to deliver within a reasonable additional period. If delivery does not take place within that period, you can cancel the order and be refunded all amounts paid, within 14 days at the latest.
Products travel at our risk until they are handed over to you. If your parcel arrives damaged or is lost, write to us: we will send the item again or refund you.
Section 9 – Right of withdrawal and returns
The law gives you 14 days to withdraw from your purchase. HappyHeats extends this period to 30 days from the day you receive your order, with no need to give a reason.
To exercise this right, let us know your decision before the end of this period, by email at contact@happyheats.com or using the withdrawal form in the appendix. We will then give you the return address. You then have 14 days to send the item back to us. Return costs are on us (at the rate of a standard tracked shipment).
We refund all amounts paid, including the original shipping costs (based on the standard shipping rate), within 14 days of your request. We may withhold the refund until we have received the item or proof that it has been shipped. The refund is made to the payment method used for the order. Any loss in value of the item resulting from handling beyond a normal trial may be deducted from the refund.
All the practical details are in our Refund policy.
Section 10 – Legal guarantees
In addition to our commercial commitments, all our products are covered by the legal guarantee of conformity and the guarantee against hidden defects. To claim them, write to us at contact@happyheats.com. As required by French regulations, here is the text that describes them:
The consumer has two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:
1° The professional refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer is not required to request repair or replacement of the goods first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the restored goods are delivered.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the application of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.
Section 11 – Optional tools
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. These tools are provided "as is" and "as available". To the extent permitted by law, we shall not be liable for anything arising from your use of these optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own discretion. You should make sure you are familiar with the terms on which these tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features through the website. Such new services and/or features will also be subject to these Terms.
Section 12 – Third-party links
Certain content, products and services available via our Service may include materials from third parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, and we do not take any responsibility for the content, products or services of these third-party websites. Please review the policies and practices of these third parties carefully before you engage in any transaction. Complaints, claims or questions regarding third-party products should be directed to the third party.
Section 13 – Comments, feedback and other submissions
If you send us reviews, ideas, suggestions or other materials, whether online, by email, by postal mail or otherwise (collectively, "comments"), you authorize us, free of charge, worldwide and for the duration of the relevant rights, to reproduce, publish, translate and use them in our communications. We are under no obligation to compensate anyone for any comments or to respond to any comments.
We may remove any content that we determine to be unlawful, offensive, threatening, defamatory, obscene, or that infringes any party's intellectual property or these Terms.
You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right. Your comments must not contain any unlawful, abusive or obscene material, or any malware. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are responsible for any comments you make.
Section 14 – Personal information
Your submission of personal information through the store is governed by our Privacy Policy. Click here to read our Privacy Policy.
Section 15 – Errors, inaccuracies and omissions
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions. In the event of an obvious pricing error (for example a ridiculously low price), we may cancel the order concerned, even after it has been confirmed, and refund you in full.
Section 16 – Prohibited uses
In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international or national regulations or laws; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate against anyone based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website. We reserve the right to suspend your use of the Service for violating any of these prohibitions.
Section 17 – Liability
We do not guarantee that your use of our site will be uninterrupted or error-free: the site may be temporarily unavailable, in particular for maintenance.
We cannot be held liable for damage resulting from use of the product that does not comply with its intended purpose or its care instructions, from the act of a third party, or from a case of force majeure.
Nothing in these Terms limits or excludes our liability where the law prohibits it, in particular in the case of personal injury, gross negligence, or under the legal guarantees of conformity and against hidden defects.
Section 18 – Indemnification
You are liable to HappyHeats for any direct loss it suffers as a result of your breach of these Terms or of the law, in particular in the event of a third-party claim.
Section 19 – Severability
In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall be deemed severed from these Terms, without affecting the validity and enforceability of any other remaining provisions.
Section 20 – Termination
You may stop using our site at any time. In the event of a serious breach of these Terms (for example fraud), we may suspend your access to the site. Orders that have already been confirmed remain governed by these Terms.
Section 21 – Entire agreement
The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms and any policies we post on this site constitute the entire agreement between you and us and govern your use of the Service.
In case of doubt about their interpretation, these Terms shall be interpreted in the way most favourable to the consumer.
Section 22 – Customer service and mediation
For any question or complaint, write to us at contact@happyheats.com or use our Contact page.
In the event of a dispute, first send a written complaint to our customer service. If no amicable solution is found, you can use, free of charge, the consumer mediator we are affiliated with: [mediator's name, address and website to be added]. If you live in another European Union country, the European Consumer Centre in your country can also help you.
Section 23 – Governing law
These Terms are governed by French law. If you live in another country, you keep the protection of the mandatory provisions of the law of your country of residence. Failing an amicable solution, the dispute will be brought before the competent courts in accordance with the ordinary rules of law.
Section 24 – Changes to the Terms
You can review the most current version of the Terms at any time on this page. We may change them at any time; the version that applies to an order is the one in force on the date of that order.
Appendix – Withdrawal form
Only complete and return this form if you wish to withdraw from your order. You can also simply email us.
